FormaPaw Terms of Service

These terms apply to purchases from the FormaPaw website and your use of the website. Please read them before ordering and keep a copy for your records.

Nothing in these terms limits your statutory rights as a consumer.

1. About us

FormaPaw sells drinkware and gifts for dog lovers.

We operate online only. Customer visits and collections are not available at our business address.

Our website, orders and customer communications are available in English. We currently deliver only to addresses within the United Kingdom.

2. Our products

We take reasonable care to describe and photograph our products accurately. Colours may look slightly different depending on your screen settings.

Minor variations in printing or finish may occur, but products must still match their description, be of satisfactory quality and be fit for their intended purpose.

Please follow the care and usage instructions supplied with each product.

3. Placing an order

Please check your items, contact details and delivery address before submitting your order. You must be legally able to enter into a binding contract and authorised to use your chosen payment method.

Your order is an offer to buy from us. We accept your order when we send your order confirmation email. At that point, a contract is formed between you and John King trading as FormaPaw.

If we cannot accept your order, for example because an item is unavailable or payment cannot be authorised, we will let you know. Any payment already taken for an order we do not accept will be refunded promptly.

If you notice a mistake in your order, please contact us as soon as possible. We will help where we can. Your cancellation rights in section 6 continue to apply even if we have started processing your order.

Our store is hosted by Shopify, but your purchase contract is with us.

4. Prices and payment

All prices are in pounds sterling (£) and include applicable taxes. Delivery charges are shown before you pay.

Available payment methods are displayed at checkout. Payment is due when you place your order.

We may change prices for future orders, but this will not change the price of an order we have already accepted.

If we identify a pricing error before accepting your order, we will contact you so you can choose whether to proceed at the correct price or cancel for a full refund.

5. Delivery

Delivery options, charges and estimated delivery times are shown on our website or at checkout.

We will deliver within the agreed period or, if no period has been agreed, without undue delay and within 30 days of accepting your order.

If delivery is delayed, please contact us. You may set a reasonable additional delivery deadline and cancel for a refund if we miss it. You may cancel immediately if we refuse to deliver, or if delivery by an agreed deadline was essential and this was clear when we accepted your order.

Products remain our responsibility until they are physically received by you or someone you nominate to receive them.

If your parcel is lost, arrives damaged or does not arrive, contact us so we can put things right. We remain responsible for resolving delivery problems with the carriers we use.

6. Cancelling because you have changed your mind

You can cancel your order without giving a reason from the time you place it until 14 days after the day you, or someone you nominate, receives the goods.

If goods from one order arrive separately, this period ends 14 days after the day you receive the last item.

We do not offer an extended change-of-mind returns period beyond your statutory cancellation rights.

How to cancel

Email hello@formapaw.com or write to our business address with a clear statement that you wish to cancel. Please include your name and order number if available.

You may use the cancellation form at the end of these terms, but you do not have to. It is enough to send your cancellation notice before the cancellation period ends.

Returning your order

If you have received the goods, send them back without undue delay and within 14 days after telling us you wish to cancel.

Returns should be sent to our business address in section 1 unless we provide a different returns address. Please contact us if you need help arranging your return. You do not need our approval to exercise your statutory cancellation rights.

Return shipping is free, however, please package them carefully to protect them during transit.

Inspecting and using products

You may unpack and inspect your purchase as you reasonably would in a shop.

If handling or use beyond what is necessary to establish the product’s nature, characteristics and functioning reduces its value, we may deduct that loss in value from your refund.

We do not charge a restocking fee.

Refunds

When you cancel your whole order, we will refund the product price and the cost of our least expensive standard delivery option. If you chose a more expensive delivery option, the additional cost is not refundable.

We will refund you without undue delay and within 14 days after receiving the returned goods or evidence that you have sent them back, whichever is earlier.

If no goods were supplied, we will refund you within 14 days after being told you wish to cancel.

Refunds use your original payment method unless you expressly agree otherwise. We do not charge a refund fee.

These cancellation provisions do not affect your rights where goods are faulty, damaged on arrival or not as described.

7. Faulty, damaged or incorrect goods

We are legally required to supply goods that match their description, are of satisfactory quality and are fit for purpose.

If goods are faulty, damaged on arrival or incorrect, contact hello@formapaw.com. Your rights in this section are separate from your right to change your mind.

You normally have a short-term right to reject goods that do not meet these requirements within 30 days of delivery and receive a full refund.

After that period, you may be entitled to a repair or replacement. If that is impossible, unsuccessful or not provided within a reasonable time and without significant inconvenience, you may be entitled to a price reduction or to reject the goods for a refund, subject to the law.

We will cover reasonable return costs for goods that are faulty, damaged on arrival or incorrect.

Please report problems promptly so we can help. Your statutory rights do not end simply because the 30-day rejection period has passed.

8. Our responsibility to you

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

Loss or damage is foreseeable if it was an obvious consequence or if both you and we knew it might happen when the contract was made.

We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be excluded or limited.

Nothing in these terms removes our responsibility for faulty or misdescribed goods or limits your statutory consumer rights.

9. Using our website

You must not use the website unlawfully, introduce malicious software, attempt unauthorised access or interfere with its operation or security.

We may restrict access where reasonably necessary for security, maintenance or preventing misuse. This does not affect our obligations for orders already accepted.

Website content, branding, artwork and designs belong to us or our licensors. You may browse the website and save or print information for personal use, including records of your purchases. Other use requires permission unless permitted by law.

10. Personal information

Our Privacy Policy explains how we collect and use personal information. Our Cookie Policy explains how we use cookies and similar technologies. Both are available on our website.

11. Questions and complaints

Please send questions or complaints to hello@formapaw.com or write to our business address in section 1.

Please include your order number, if available, and a description of the issue so we can investigate and respond.

12. Changes to these terms

We may update these terms for future orders. The version in force when we accept your order applies to that order unless you agree otherwise.

If a court finds any part of these terms unenforceable, the remaining terms will continue to apply.

13. Applicable law

These terms are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you also benefit from any mandatory consumer protections that apply where you live.

You may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the UK where you live.

Cancellation form

Complete and send this form only if you wish to cancel your order. You may also cancel by another clear statement, including email.
